SpotRight Android Terms of Use

1. Who These Terms Apply To

These Terms of Use apply when you access or use the SpotRight Android app, related account features, cloud sync, family sharing, public share links, support channels, and related website resources that link to these Terms.

SpotRight is operated by Storokiv S.à r.l.-S, a Luxembourg company with registered office at 120, Rue du Cimetiere, L-8018 Strassen, Luxembourg, registered with the Luxembourg trade and companies register under B307331.

2. Related Documents

These Terms are the main terms for the SpotRight Android app. The following documents also apply where relevant:

• the SpotRight Privacy Policy, which explains how SpotRight processes personal data;
• the SpotRight Subscription Terms, which apply to paid subscription features purchased through Google Play;
• the SpotRight Public Share Terms, which apply when you create public share links; and
• the SpotRight account and data deletion page, which explains how to request account deletion and data export.

If a related document applies to a specific feature, it supplements these Terms. If there is a conflict about a specific topic, the more specific document controls for that topic. For example, the Subscription Terms control for subscription billing, renewal, cancellation, refunds, and paid-entitlement handling. The Public Share Terms control for public share links and public-share content rules.

3. Acceptance

You may use basic local-only app features without creating an account. By creating an account, enabling cloud-backed features, joining or creating a family space, creating a public share link, or otherwise accepting these Terms in the app, you agree to these Terms.

SpotRight may require manual acceptance of these Terms or related documents before you can use certain features. This may include account features, cloud sync, family sharing, subscription-backed features, or public sharing. Where manual acceptance is required, SpotRight may record the document version, locale, timestamp, account, and acceptance source.

If you do not agree to the applicable terms, do not use the relevant feature.

4. The App

SpotRight is an offline-first Android app for organizing household items and related information. Basic use can remain local to your device. Account-based and subscription-backed features can sync eligible content to cloud services, restore content across devices, enable family sharing, and enable public share links where available.

SpotRight is not intended to be the only copy of important records. You are responsible for keeping separate copies of information that is important to you, including export files, documents, photos, and other records.

5. Accounts and Security

You are responsible for keeping your account credentials and devices secure. Do not share your login credentials with another person. If you believe your account has been compromised, contact support@spotright.app.

You must provide accurate account information where required and must not impersonate another person, create accounts in another person's name, or use the app in a way that interferes with security, integrity, or availability.

SpotRight may restrict, suspend, or terminate access where we reasonably believe this is necessary to protect users, the service, legal compliance, or the integrity of the app.

6. Local-Only Use and Cloud Features

When you use SpotRight without cloud-backed features, your app content generally remains on your device, subject to any connected features you choose to use, such as support, crash reporting, optional analytics, barcode lookup, or sharing.

When you use cloud-backed features, eligible content may be uploaded, stored, synced, restored, shared with authorized family members, or made available through public share links if you create them. Cloud-backed features may require an account, a subscription entitlement, network access, and acceptance of applicable terms.

7. Subscriptions

Paid SpotRight subscription features for Android are sold and billed through Google Play. Google Play is the merchant of record for Android subscription purchases.

Subscription billing, trials, renewals, cancellation, refunds, entitlement changes, and retention after subscription expiry are described in the SpotRight Subscription Terms and in the Google Play purchase flow. You must review the Google Play checkout terms before purchasing.

Nothing in these Terms limits mandatory consumer rights that apply to you.

8. Family Space

Family Space is a closed, invite-only collaborative workspace for household item management. It is not a public feed, public gallery, or passive publishing channel.

Family members are active collaborators. Any active family member may edit or delete shared item-level content in the Family Space, subject to the app's feature rules. This may include shared item names, tags, ratings or scores, barcode values, photos, and other item-level details.

Per-member notes have a different model. A member may edit their own note. Other family members may remove a note from the shared family item, but they may not rewrite the note as if they authored it. Notes attached to family items are visible to family members and are not private personal notes.

Do not place content in Family Space unless you are allowed to share it with the family members who can access that space.

Family owners and members may have controls such as creating or accepting invitations, leaving a family, removing members, revoking invitations, transferring ownership, or deleting a family, depending on their role and the available app features.

9. Public Share Links

Public share links are different from Family Space. If you create a public share link, anyone who has a valid link may view the shared content until the link expires, is revoked, or is removed.

Only share content publicly if you have the right to share it and are comfortable with anyone who receives the link viewing it. Public share links may be subject to separate manual acceptance of the SpotRight Public Share Terms before you can create them.

SpotRight may disable or remove a public share link if it violates these Terms, the Public Share Terms, applicable law, or platform requirements.

10. User Content

You keep the rights you have in content you add to SpotRight. You are responsible for the content you create, upload, store, sync, place in Family Space, or make available through public share links.

You grant SpotRight a limited, non-exclusive, worldwide licence to host, store, copy, process, transmit, display, and otherwise use your content only as needed to operate, secure, support, moderate, and improve the app and related features, including cloud sync, family sharing, public share links, data export, account deletion, support, abuse prevention, and legal compliance.

You must have the rights and permissions needed to upload, store, share, or publish the content you add to SpotRight.

11. User Content Rules

You must not upload, store, share, publish, or use SpotRight for content or activity that is:

• illegal or intended to facilitate illegal activity;
• abusive, harassing, threatening, hateful, or discriminatory;
• sexually exploitative, child-endangering, or involving child sexual abuse material;
• non-consensual, privacy-violating, doxxing, or exposing another person's personal information without permission;
• infringing another person's intellectual property or other rights;
• unsafe, deceptive, fraudulent, spam, scam, malware, or security-abuse content;
• graphic, shocking, or otherwise objectionable in a way that is inappropriate for SpotRight's household-item purpose;
• designed to interfere with the app, other users, service providers, or security controls; or
• otherwise in violation of these Terms, related terms, applicable law, or platform requirements.

If you find content or behavior that may violate these rules, use the available report option or contact support@spotright.app.

12. Reporting, Moderation, and Enforcement

SpotRight may review reports and take action where appropriate. Actions may include removing or disabling shared content, revoking public links, limiting access to sharing features, suspending or terminating accounts, preserving limited records for compliance or dispute handling, or taking other appropriate action.

Family members can often resolve their own shared item content by editing or deleting it. Reporting remains available where content or behavior appears abusive, illegal, unsafe, or shared without permission.

If you can view a shared item through a valid public share link, you may be able to report that shared item through the share link. Reports are handled through the share link and do not expose internal item identifiers. If a link has expired or you only have a screenshot, contact SpotRight support with the public URL or screenshot and a description of the concern.

SpotRight may apply rate limits and other abuse-prevention controls to reporting tools to prevent spam, automated misuse, harassment, or false repeated reports.

13. Barcode and Product Information

SpotRight may use device-side barcode recognition and external product lookup sources to help identify products. Product information from external sources may be incomplete, outdated, inaccurate, or unavailable.

Do not rely on SpotRight as the only source for safety-critical product information, including allergens, expiry, recalls, dosage, warnings, or other health or safety information. Always check the product label and other authoritative sources where accuracy matters.

14. Photos and Files

You are responsible for photos and files you add to SpotRight. Do not upload, store, place in Family Space, or publicly share photos or files unless you have the right to do so.

Photos and imported files may contain embedded metadata. The Privacy Policy explains how SpotRight handles photo and media data.

15. Account Deletion, Export, and Inactive Accounts

You can request data export and account deletion through the app where available. The account and data deletion page explains the available deletion path, alternative contact method, and consequences of account deletion.

Before deleting your account, export any data you want to keep. Export file links may stop working after account deletion because the underlying data may be erased.

If you delete your account, SpotRight may request cancellation of future Google Play renewal for an active linked subscription where supported. This does not create an automatic refund for the current billing period.

If a free SpotRight account has no account activity for 3 years and is not linked to an active subscription or active family service, SpotRight may delete the account and associated cloud data after reasonable advance notice where we have a valid contact method. Limited records may be retained where required or appropriate for legal obligations, accounting, security, abuse prevention, moderation, dispute handling, or enforcement of these Terms.

16. Third-Party Services and Platform Terms

SpotRight depends on third-party services and platform providers, including Google Play for Android purchases and subscription management. Your use of those services may be subject to their own terms and policies.

SpotRight may also connect to external product lookup services when barcode lookup is triggered. Those external services are responsible for their own content, availability, and privacy practices.

17. App Changes and Availability

SpotRight may improve, change, suspend, or discontinue features over time. We try to avoid materially misleading descriptions of paid features. Where required by law or platform rules, we may provide additional notice of material changes.

Some features may depend on network connectivity, subscription status, Google Play availability, service-provider availability, device permissions, app version, or regional availability.

18. Intellectual Property

SpotRight, including the app, design, software, branding, and related materials, is owned by Storokiv S.à r.l.-S or its licensors and is protected by applicable intellectual-property laws.

These Terms do not transfer ownership of SpotRight software or branding to you. You may use the app only as permitted by these Terms, applicable platform rules, and applicable law.

19. Restrictions

You must not:

• reverse engineer, copy, modify, or distribute the app except where mandatory law permits it;
• bypass authentication, entitlement, quota, sharing, moderation, or security controls;
• access or attempt to access another user's account, private data, family space, or cloud resources without permission;
• use automated systems to abuse, scrape, overload, or interfere with the app or related services;
• misuse support, reporting, invitation, public-share, or subscription systems; or
• use SpotRight in a way that violates applicable law, platform rules, or another person's rights.

20. Disclaimers

SpotRight is provided using reasonable care and skill. However, except where mandatory law provides otherwise, the app and related services are provided without guarantees that they will be uninterrupted, error-free, or available at all times.

SpotRight is not professional, legal, medical, food-safety, or emergency advice. You remain responsible for decisions based on information you store, scan, import, or retrieve through the app.

21. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for fraud, intentional misconduct, or mandatory consumer rights that cannot be waived.

To the maximum extent permitted by applicable law, SpotRight is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, loss of profits, loss of business, or loss of goodwill arising from your use of the app.

Where liability cannot be excluded but can be limited, SpotRight's liability is limited to the amount you paid for the affected SpotRight subscription during the 12 months before the event giving rise to the claim, unless mandatory law requires a different result.

22. Termination

You may stop using SpotRight at any time. You may delete local data from your device and may request account deletion where available.

SpotRight may suspend or terminate access if you violate these Terms, create legal or security risk, abuse the service, or use the app in a way that may harm other users, SpotRight, service providers, or platform compliance.

Termination does not affect provisions that should reasonably continue, including intellectual-property rights, content licences needed for completed processing, payment obligations, retention rules, disclaimers, liability limits, governing law, and dispute provisions.

23. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may provide notice in the app, by email, or through other appropriate means. Where required, we may ask you to accept the updated Terms before continuing to use specific features.

If you do not agree to updated Terms, you must stop using the affected features.

24. Governing Law and Disputes

These Terms are governed by the laws of Luxembourg, without prejudice to mandatory consumer-protection rights that may apply in your country of residence.

If you are a consumer, you may have the right to bring claims in the courts of your country of residence under mandatory consumer-protection rules. Nothing in these Terms limits rights that cannot be waived under applicable law.
